The
constitution says essentially
you would have to be totally
unfit as a parent to be denied
your children. Fifty-fifty
responsibility is the only
thing that makes sense as
a starting point for separating
couples. This is called
"shared parenting"
and received 85% support from
voters in Massachusetts in
a 2004 non-binding referendum.
But too many judges, lawyers,
GALs and others are making
too much money for this system
to change easily. The
courts ignore this law every
day in almost every case,
blindly awarding full custody
to mothers and "visitation"
to fathers as standard operating
procedure due to long-term
tradition and sexual bias
that is not only obsolete
but is also illegal by federal
AND state laws.
Follow
the money - This makes for
great legal battles and LOTS
of money for lawyers - over
$250 Billion each year is
involved. This practice
IS ILLEGAL, IMMORAL and IRREPARABLY
DAMAGING AN ENTIRE GENERATION
OF OUR CHILDREN EVERY DAY
ALL ACROSS THE U.S.
This practice MUST stop with
equal parenting laws forcing
the default to be what is
actually already
guaranteed by our constitution!
Yet because judges are accountable
to no one, and break these
higher laws every day with
immunity it has continued
for decades. If a real
jury saw these rulings they
would be disgusted at the
most common results and slipshod
way these decisions are made.
Judges
are "legislating from
the bench", effectively
doing whatever they want in
spite of the current laws
of the land created by the
people in the constitution
and federal courts. God help
the fathers that get in front
of judge who had strict fathers
in the 1950s and 1960s. I
have even seen a judge have
an adolescent outburst just
because I said "objection
your honor" to a hearsay
comment by the opposite side
- sending over the bailiff
to intimidate and control
and protect his little personal
dynasty from any sort of challenge.
Power corrupts and absolute
power corrupts absolutely.
The states need to get out
of the parenting business
and our personal affairs!
There
are five major issues this
web site provides information
on which collectively make
the injustices discussed below
not only possible, but the
most common result today.
All could probably be solved
by proper shared
parenting legislation
which would take the huge
money out of the equation
for the divorce and domestic
violence industry and created
better results for our children
and fathers:

(or more appropriately
child
extortion, another
story, the
average overpayment,
government
corruption caused by illegal

Order (RO) Abuse
(False claims of domestic
violence and fear) -
Most attorneys agree (in
private) that most (Some
say up to 95%) of ROs are
false and baseless, but
never the less they are
often given out like candy
on any woman's utterance
of the word "fear".
Judges are afraid NOT to
grant them but violate their
oath of office when they
do because of fear of media
etc. This takes away
virtually all of the man's
constitutional rights to
his children and property
instantly and without any
due process, proof or even
accusation of wrongdoing.
A highly profitable industry
has built itself around
this called the "Domestic
Violence" industry.
There is clearly a better
answer than this for real
domestic violence with all
the protections of the constitution
extended to both parties.

About the Divorce Courts

The
process and ways to fight
for your rights. These are
"kangaroo courts"
that ignore required procedures,
the constitution and federal
Supreme Court rulings almost
every day, in almost every
case. Yes it is hard to
believe, but true. I was
brought up believing judges
were fair and unbiased.
Nothing could be further
from the truth in these
local and family courts
they are drive by the self
interest of the people there,
not by the real law.
- The
Constitutional
Rights of ALL Parents,
The 14th Amendment, Equal
Rights and other laws that
are ignored daily to deny
fathers their rights and
generate more money for
lawyers, (trust
your attorney?). The
constitution and Supreme
Court ruling are very clear
on these matter by the family
courts ignore this higher
law - One judge said when
discussing an appeal "I
overrule the SJC every day".
This is illegal and that
judge should be removed
fro the bench.
- Judicial
Abuse - "Follow
the money" and power.

Fighting
on Their Level. I have
been told local district
judges are in the habit
of saying "I overrule
the appellate and superior
courts every day."
This is a statement of ego
and doing this is unlawful.
Judges are required to find
the facts and apply the
law, not make it according
to their own opinions. This
statement says they know
the law and do something
else, which is a breach
of their oath and illegal.
I have seen the law broken
almost every time I am in
court by judges and lawyers
who play fast and loose
and hope you don't know
enough to know the difference.
I
have studied this for a long
time now and continue to be
shocked at the bias, corruption
and stereotypes that drive
the decisions in family courts
today. The stories are
unbelievable, but true. Look
at the Bridgett
Marks Case. These
courts are kangaroo courts;
as they have no jury and therefore
no real "due process"
guaranteed by the constitution
and designed to prevent bad
laws and powerful self-interested
groups from taking over.
This has happened as a result
of strong feminist groups
with huge political power
with no counterbalancing men's
rights groups. Feminists
are demonizing dads as "deadbeats"
and "abusers" and
because the people in the
system are getting rich via
the system it grows nonstop.
Anecdotes make interesting
news and sell newspapers and
TV ads, yet the stories about
women who do wrong are often
downplayed or ignored. Interestingly
it is actual fact that women
are just as likely to be physically
abusive
to both husbands and children!
Shocking?
Yes because all we hear in
the media are the opposite
stories about "deadbeat
dads" and "abusive
men". We all have
sympathy for single moms -
I know I did until I found
out the truth. Single
dads are the victims of this
process 95% of the time.
These stories are publicized
by a massive public relations
machine funded by women's
rights groups and federal
funds they have procured through
grants, lobbying, media and
political clout by exaggerating
their membership (some say
by a factor of 10) and the
scope of this problem. These
people want an unfair advantage,
not equal rights, for women
alone. There is no balance
to support men's rights -
men have effectively been
swept under the rug by one
sided lobbying and women's
groups gone wild. The laws
have been changes to tae the
worst case scenario (real
domestic violence) and turn
that against all men, even
those NOT accused of anything.
The pendulum
has now swung way too far
and men must act. Studies
which prove the opposite is
true are "politically
incorrect" and dangerous
for politicians who fear the
wrath of women's rights groups
- so they are swept under
the carpet. It is also
a fact that mothers verbally
degrade the fathers in front
of the children four times
more often than fathers
do. Many of these
statistics can be found in
the WONDERFUL book "Father
and Child Reunion" that
I recommend to all.
The
stories you find on this web
site will amaze and shock
you, and are often hard to
believe because they are so
un-American and sexist. Most
of us were brought up believing
that judges were fair and
unbiased. You took the required
U.S. history course in high
school and learned about the
Revolutionary War, the three
government branches and the
civil war. Well history
is repeating itself and a
tyranny (literally) has returned
as our forefathers expected.
Unfortunately the system our
forefathers designed, specifically
to break away from a tyranny
with great forethought, and
even genius, has been circumvented
by these courts completely.
This system requires a jury
trail to prevent abuses by
judges and special interests
who create bad laws.
The
$250 Billion divorce industry
is self-serving and encourages
as much battling as possible
to maximize legal fees and
child support payments because
the bigger these get the richer
they get. They do not want
shared parenting because all
the custody battles, restraining
orders and big legal fees
that result would just go
away. The federal government
gives states HUGE incentives
to grow their child support
collections with HUNDREDS
OF MILLIONS in bonuses (kickbacks),
which go directly back to
the courts. Some claim
these go directly into judges
retirement funds. Either
way it is a noble cause (proper
support for children) bastardized
by overcompensation and worst
case anecdotes getting huge
media coverage and creating
a misinformed public. We all
know dads have changed a lot
in the last 50 years and participate
in raising their children
much more. The studies
are in that without this influence
children do MUCH worse, and
in fact custodial dads are
more often producing better
results than custodial moms.
Little
UNIFIED fighting back from
fathers has allowed this industry
to grow into a monster where
only lawyers, judges and bureaucrats
win.
Men
are not only emasculated in
this process by making them
look crazy just for fighting
for their rights to participate
with their children, but they
are financially and emotional
destroyed. Divorce is
even the #3 reason for bankruptcy
because fathers are forced
to pay unfair child support
amounts that are really a
form of slavery and do not
go to the child, but the ex-wife.
Only a massive effort by this
class of people being discriminated
against (non-custodial fathers)
will change this. Currently
there are class
action suits happening
in at least 46 of the 50 states.
There are hundreds of groups
formed to help, but little
coordination of resources,
finances and membership to
create the critical mass needed
to force real change soon.
We need unity!
This
current family and probate
court system is actually CAUSING
the "deadbeat dad"
syndrome by making men immediately
indigent with unreasonable
financial support orders.
This industry gets a "piece
of the action" indirectly
through federal kickbacks
of BILLIONS of Dollars.
Hundreds of millions of dollars
to Massachusetts alone.
I myself was ordered to pay
280% of my current income
for the benefit of my wife
so she could live in the home
I built 8 years before I even
met her. I even had prenuptial
agreement to prevent this
home hijacking, but it has
yet to do me any good now
9 months into my divorce!
Why? Only because she was
willing to say the word "fear"
in front of a judge in a 3
minute hearing to get a restraining
order issued. These are given
out like candy with not even
the requirement of any incident
or proof. In my case not even
the accusation that anything
ever happened that would meet
the legal requirement to issue
such a draconian order that
effectively took away all
my rights with the stroke
of a pen.
Most
states now force child support
payments that push fathers
into poverty immediately and
make them unable to support
themselves. Massachusetts
has the highest Child support
payments of all 50 states
- In other words 49 other
states think Massachusetts
guidelines are too high.
In Massachusetts anyone not
earning over $70,000/year
can not possible afford to
even live alone in a small
apartment because 40% of their
after tax earnings go to child
support and 30% go to taxes
- How can someone live on
30% of their past income?
In addition the custodial
parent (read wife) will get
tall the tax benefits and
can make $20,000 without any
change in this child support
(read alimony). These
payments often come to over
five times the cost of
raising a child (sometimes
10X or more), when fathers
should be paying only 50%!
So fathers are often paying
10X what is fair and reasonable!!
This is really just alimony
in disguise in a society where
most non-divorced parents
work. Divorced mothers with
children in school should
be required to work to support
themselves too. The states
have effectively created a
welfare system for divorced
mothers funded by fathers.
The disparity creates women
living high on the hog without
working much at all and indigent
men who are working hard and
often thrown in jail because
they can not keep up with
the ordered payments, or just
lose a job.
