Although I worry that some of you may be using his legal arguements to your detriment (which I myself have done), I feel compelled to expose a new trend that is being used against fathers... the Mental Competency Hearing.

I have been following a case in Santa Clara county where the father was falsely accused of domestic violence and exposed a fraud and corruption.  He had the evidence (some of which has been "lost"  from the court file, but which we have certified copies).  He was put in a psych ward for 3 years.

Now, I have personally heard JR speak, and while he is academically correct, the issue is going to be whether or not he is competent to assist his Public Pretender.  In that narrow scope, no, he isn't.  He views the entire legal system as a sham, dating back to the 1800s.  So, he would not be able to legally assist counsel.  Based on the report, I believe he will be committed.  They will never let him speak in court, despite his constitutional right to do so.

So, this is the issue which I am concerned about.  I wanted to bring it up because I have been told, off the record, that this is the agreed upon technique to deal with these constitutional challenges.  So anyone challenging the courts authority will be scrutinized.
